MULTIVERSE & INFINIVERSE

These Terms of Service (these “Terms ”), apply to our Multiverse Browser and related Infiniverse Network, along with related websites; networks; desktop applications, console applications and / or mobile applications, and / or similar products and the related services provided by us via such products, (collectively, our “Service(s)”).

Please note that certain other features are offered by FTL as separate services to the main Multiverse Browser and Infiniverse Network, including the ability to acquire rights of access to apartments, or control of areas of land, or to subscribe to storefronts and related points of access, and these are subject to separate terms and conditions.

Please note that any Metacoins or other Virtual Items have no real world value. More information on these items can be found here.

These Terms, which include any other terms, policies, guides or other documents specifically referenced, amount to a legally binding contract between you and FTL regarding your use of the Service(s).

The Services are offered by Future Tech Labs Limited, a UK company with companies house number 10485908, registered at Unit 4 Ardington Courtyard Roke Lane, Witley, GU8 5NF, Surrey, United Kingdom, and offices located at 6 Huxley Road, Surrey Research Park, Guildford, GU2 7AF, Surrey, United Kingdom (“FTL”, “us”, “we”, or “our”).

PLEASE READ THE FOLLOWING TERMS CAREFULLY. BY USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.

If you are not eligible, or do not agree to these Terms, then you do not have our permission to use the Services.

Your privacy and the protection of your personal data is important to us. Please see our Privacy Policy, which forms part of the Terms, for details of how we will use and process your personal data. We may also use cookies or other online identifiers.  Please see our Cookie Policy, for more details of how we and others use cookies and similar technologies.

We may update these Terms from time to time and you should regularly check to see if any changes have been made. Ongoing use following such changes or notification will be deemed acceptance of the changes.

1. Multiverse Browser / Service Overview – a metaverse browser

   1. The Multiverse Browser is a metaverse browser platform to facilitate the display and browsing of 3D and/or metaverse related content and locations, as well as 2D content and websites.

2. Infiniverse Network / Service Overview – a metaverse hub

   1. Infiniverse Network is a metaverse hub for discovering and otherwise experiencing 3D and/or metaverse related content and locations as well as 2D content and websites.

   2. ​FTL facilitates such discovery by providing  a point of presence or access point in the Infiniverse Network to third parties who wish to set up and/or provide access to their own metaverse location.  

   3. These points of presence or access points are enabled through Infiniverse apartments, penthouses, as well as storefronts, skyscrapers and other promotional or named locations.  For more information on acquiring  these points of presence or access points spaces from FTL see Section @ below.  These separate features are offered by FTL as separate services to the main Infiniverse Network, and are subject to separate terms and conditions. 

   4. Please note that when you enter or otherwise interact with these types of third party operated locations as a visitor, you are leaving the FTL controlled areas and engaging directly with third party metaverses, environments, areas, websites and services. See Section @ below for more on these Metaverse Locations.

3. Eligibility

   1. You must be at least 13 years of age to use the Service(s). By agreeing to these Terms, you represent and warrant (promise) to us that: (a) you are at least 13 years of age; (b) you have not previously been suspended or removed from the Service(s); and (c) your registration and your use of the Service(s) complies with all applicable laws and regulations. 

   2. If you are at least 13 but are under the age of 18, you may only use the Service(s) with your parent's or guardian's consent and your parent or guardian must provide consent after having read these Terms. In such a case you represent and warrant that both you and your parent or guardian have read and consent to these Terms (including all the conditions, limitations, disclaimers, and waivers provided herein). 

   3. If you are a parent or guardian consenting to these Terms on behalf of a child between the ages of 13 and 18, you additionally agree to guarantee and be fully responsible for that person’s performance under the Terms, including all financial obligations or liability he or she may incur, and all disclaimers and waivers of applicable legal protections provided here. 

   4. In all other cases, you represent that you are 18 years or older and fully competent to enter into these Terms. If you are using the Service(s) on behalf of an entity, organisation, or company, you represent and warrant that you have the authority to bind that organisation to these Terms and you agree to be bound by these Terms on behalf of that organisation.

4. Accounts and Registration

   1. To access the Service(s) or certain features of the Service(s), you may be required to register for an account or log in with an existing third party account such as your social media or other platform account. 

   2. In registering or using a third party account, you may be required to provide us with some information about yourself, such as your email address or other contact information. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. 

   3. If and when you register, you will be asked to provide a password. You are solely responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account. If you have reason to believe that your account is no longer secure, then you must immediately notify us at support@FTL.ltd.

5. FTL Software License

   1. Subject to your complete and ongoing compliance with these Terms, FTL grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use certain software that we make available to you (collectively, the “FTL Software”) including as downloaded directly from FTL’s website or from a legitimate marketplace (such as the Oculus, Steam, Samsung, or PlayStation store), solely in object code format, for your personal use for lawful purposes, on a compatible device you own or control, and to access and use the Service(s) provided via the FTL Software in accordance with these Terms. 

   2. The term FTL Software, as used in these Terms, includes any update or modification to the FTL Software made available to you by FTL (unless provided with separate terms). 

   3. If you are prohibited under applicable law from using the FTL Software or the Service(s), you may not use them.

   4. You may not use the FTL Software or the Service(s) for any purpose other than a purpose for which the FTL Software and the Service(s) are expressly designed. 

6. Third Party Platforms and Terms

   1. Use of the Service(s) may be enabled or facilitated through certain external third-party products, services, or platforms including enabling you to log in via those third party platforms (“Third Party Platforms”).  These Third Party Platforms may include Oculus, Meta, PlayStation, Steam, Samsung, Apple, Google or other services or platforms.

   2. You acknowledge that such Third Party Platforms are governed by the terms and conditions, rules, policies, guidance and privacy policy of such Third Party Platform (“Third Party Platform Terms”), and you must comply at all times with the Third Party Platform Terms.

   3. FTL does not endorse, is not liable for, and makes no representations as to the relevant Third Party Platform, its content, or the manner in which such Third Party Platform uses, stores, or processes your data or content, and we are not liable for any damage or loss arising from or in connection with such Third Party Platform.

   4. Certain features of our Service(s) may depend on the availability of these Third Party Platforms and the features and functionality they make available. We do not control Third Party Platform features and functionality, and they may change without any notice to us. If any Third Party Platform stops providing access to some or all of the features or functionality currently or historically available to us, or stops providing access to such features and functionality on reasonable terms, as determined by us in our sole discretion, we may stop providing access to certain features and functionality of our Service(s).

7. Metaverse Locations

   1. The Service(s) may enable you to discover or otherwise may contain links to third party metaverses, environments, areas, websites and services (“Metaverse Locations”), including through apartments, penthouses, storefronts, skyscrapers in the Infiniverse Network, and/or other third party controlled locations, advertising, promotions, portals or other links. 

   2. The Metaverse Locations viewed, accessed, linked to or otherwise available through the Service(s) are created, owned or controlled by third parties. FTL are not responsible for the content, accuracy or opinions expressed on such Metaverse Locations, and FTL does not control or promise to actively monitor the content or features of these Metaverse Locations. 

   3. FTL makes no representation, warranty or commitment and shall have no liability or obligation whatsoever in relation to the Metaverse Locations and does not endorse or approve any third-party nor the content of any of the third-party made available via the Metaverse Locations.

   4. You understand that any Metaverse Location you visit is at your own risk. 

8. Acquiring  or subscribing to Infiniverse points of presence or access points to your own Private Location or Business Location – separate services

   1. To enable the discovery of an individual's or a business’s third party Metaverse Location, FTL makes available points or presence or access points within buildings or elsewhere in Infiniverse. 

   2. Individual visitors to Infiniverse can acquire points or presence or access points by way of Apartments or Penthouses, to operate them as private spaces, and possibly to sell or otherwise trade such locations.  These separate features are offered by FTL as additional services within the Infiniverse Network, and are subject to separate terms and conditions.    3. Business users of Infiniverse can acquire points or presence or access points by way of a Storefronts, Skyscrapers or other locations in buildings or elsewhere in Infiniverse to operate them as private business spaces. Only business users may establish such locations.  These separate features are offered by FTL as additional services to the within the Infiniverse Network, and are subject to separate terms and conditions. 9. User Behaviour. Behaviour Code

   1. In using our Service(s) you will have the opportunity to interact with other users including in live, social  and virtual worlds.  We expect a certain standard of behaviour when interacting with other users.  

   2. All users must at all times comply with and follow the spirit of our Behaviour Code (“Behaviour Code”), as well as any Third Party Platform Terms.

   3. User Behaviour Disclaimer. We are under no obligation to moderate, edit or control user behaviour of you or other users, and will not be in any way responsible or liable for user behaviour. FTL may, however, at any time and without prior notice, screen, remove, edit, make private or block any user that in our sole judgement violates these Terms or is otherwise objectionable. You understand that when using the Service(s) you will be exposed to users and behaviour from a variety of sources.  WE EXPRESSLY DISCLAIM ANY AND ALL LIABILITY IN CONNECTION WITH USER BEHAVIOUR. 

   4. If notified by a user or content owner that any user behaviour allegedly does not conform to these Terms, we may investigate the allegation and determine in our sole discretion whether to screen, remove, edit, make private, or block  the user, which we reserve the right to do at any time and without notice.

10. User Content

    1. Certain features of the Service(s) may permit users to interact via text and voice, upload, stream, post or otherwise share content publicly (“Post / Posting”), including voice, messages, photos, video, images, folders, data, text, and other types of works, including in live, social  and virtual worlds (“User Content”). 

    2. You retain copyright and any other proprietary rights that you may hold in the User Content you Post or otherwise share in the Service(s). 

    3. By Posting or otherwise publicly sharing User Content in the Service(s), you grant FTL a worldwide, non-exclusive, irrevocable, royalty-free, perpetual, fully paid right and license (with the right to sublicense) to host, store, record, transfer, display, perform, reproduce, modify for the purpose of formatting for display, and distribute your User Content, in whole or in part, in any media formats and through any media channels now known or hereafter developed.

    4. By Posting or otherwise publicly sharing User Content via the Service(s) you grant all users a non-exclusive license to access and use that User Content as permitted by these Terms and the functionality of the Service(s). 

    5. You are solely responsible for your User Content and the consequences of Posting or sharing User Content. By Posting or sharing User Content, you affirm, represent, and warrant (promise) that: (a). you are the creator and owner of the User Content or have the necessary licenses, rights, consents, and permissions to authorise FTL and users of the Service(s) to use your User Content as necessary to exercise the licenses granted by you in this section, in the manner contemplated by FTL, the Service(s), and these Terms; and (b). your User Content and the use of your User Content as contemplated by these Terms, does not and will not violate the Behaviour Code and/or Section 9 below.

    6. Where permitted you may delete copies or instances of your User Content that you have Posted through the normal functionality of the Service(s). If you delete your User Content through use of that functionality, the licenses granted by you to Your Content terminate with respect to the particular copies or instances of your User Content that you have deleted.  We cannot guarantee that we will be able to delete other copies or instances already shared or distributed, or needed for record keeping or legal purposes.

    7. User Content Disclaimer. We are under no obligation to moderate, edit or control User Content that you or other users Post, and will not be in any way responsible or liable for User Content. FTL may, however, at any time and without prior notice, screen, remove, edit, or block any User Content that in our sole judgment violates these Terms or is otherwise objectionable. You understand that when using the Service(s) you will be exposed to User Content from a variety of sources and acknowledge that User Content may be inaccurate, offensive, indecent, or objectionable.  WE EXPRESSLY DISCLAIM ANY AND ALL LIABILITY IN CONNECTION WITH USER CONTENT. 

    8. If notified by a user or content owner that User Content allegedly does not conform to these Terms, we may investigate the allegation and determine in our sole discretion whether to remove the User Content, which we reserve the right to do at any time and without notice.

11. Prohibited Conduct and Restrictions
    BY USING THE SERVICE YOU AGREE NOT TO:
    use the Service(s) for any illegal purpose or in violation of any local, state, national, or international law;

    1. violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third party intellectual property right;

    2. violate, or encourage others to violate, our Behaviour Code or other rules or policies;

    3. violate, or encourage others to violate, any Third Party Platform Terms;

    4. post, upload, or distribute any User Content or other content that is unlawful, defamatory, libellous, inaccurate, violate another’s privacy or confidentiality, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, embarrassing, hateful, or otherwise inappropriate;

    5. share, publicly post, copy, or distribute another user’s User Content outside the permissions granted in these Terms;

    6. interfere with security-related features of the Service(s), including but not limited to by disabling or circumventing features that prevent or limit use or copying of any content;;

    7. upload to the Service(s) any software code, routine, or instructions that interfere with, or otherwise attempt to impair, the operation of the Service(s), any user’s enjoyment of the Service(s), or any user’s underlying code or hardware, including by: (a) uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code; (b) attempting to collect personal information about another user or third party without consent; or (c) interfering with or disrupting any network, equipment, or server connected to or used to provide the Service(s), or violating any regulation, policy, or procedure of any such network, equipment, or server;

    8. decipher, reverse engineer, decompile, or disassemble the Service(s) or the FTL Software, or the software used to provide the Service(s) or the FTL Software, in whole or in part, or authorise, direct, or cause a third party to do so;

    9. use, display, mirror, frame, or utilise framing techniques to enclose the Service(s) or any content available through the Service(s), or any portion or component of the Service(s);

    10. use any robot, spambot, spider, crawler, scraper, or other automated means or interface not provided by us to access the Service(s) or to extract or reutilise data;

    11. sell, license, distribute, copy, reproduce, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or use the any elements of the Service(s) except as expressly authorised under these Terms

12. Purchases and Payment 

    1. There may be opportunities to purchase  certain items, tokens, coins, upgrades, subscriptions or other features of or in the Service,

    2. Payment may via a Third Party Platform, and you will be subject to their Third Party Platform Terms. 

    3. If payments are made directly to FTL, please see HERE for more details on payments including in relation to cancellation, returns, refunds and payment processing policies.

13. Termination of Use; Discontinuation and Modification of the Service(s)

    1. If you violate any provision of these Terms, your permission from us to use the Service(s) will terminate automatically. 

    2. In addition, FTL may in its sole discretion suspend or terminate your access to the Service(s) at any time for any reason or no reason, with or without notice. 

    3. We also reserve the right to modify or discontinue the Service(s) at any time (including by limiting or discontinuing certain features of the Service(s)), temporarily or permanently, without notice to you. 

    4. We will have no liability whatsoever on account of any change to the Service(s) or any suspension or termination of your access to or use of the Service(s).

14. IP Ownership, Reservation of Rights

    1. The Service(s), including the FTL Software, is owned and operated by FTL. 

    2. The Service(s), FTL Software, including all and any content, visual interfaces, interactive features, information, graphics, design, compilation, computer code, products, services, designs, get up. look and feel, and all other elements of the Service(s) (the “FTL Materials”), are protected by copyright, patent, trademark, database rights and other intellectual property rights, laws  and international conventions. 

    3. As between you and FTL, all FTL Materials, including all associated intellectual property rights, are the sole and exclusive property of FTL, its subsidiaries or affiliated companies, or its third-party licensors. 

    4. FTL reserves all rights not expressly granted in these Terms. You do not acquire any right, title, or interest to the FTL Materials, whether by implication, estoppel, or otherwise, except for the limited rights set forth in these Terms.

15. Indemnity

    1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU WILL DEFEND AND INDEMNIFY FTL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONSULTANTS, AFFILIATES, SUBSIDIARIES, AND AGENTS (TOGETHER, THE “FTL ENTITIES”) FROM AND AGAINST EVERY CLAIM, LIABILITY, PROCEEDINGS, ACTIONS, DAMAGE, LOSS, AND/OR EXPENSE, INCLUDING REASONABLE LEGAL FEES AND COSTS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR VIOLATION OF ANY PORTION OF THESE TERMS, ANY REPRESENTATION, WARRANTY, OR AGREEMENT REFERENCED IN THESE TERMS, OR ANY APPLICABLE LAW OR REGULATION.

    2. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to cooperate with our defence of that claim.

16. Disclaimers; No FTL Warranties

    1. THE FTL SERVICE, FTL SOFTWARE AND ALL FTL MATERIALS AND/OR OTHER FEATURES OR CONTENT AVAILABLE THROUGH THE SERVICE(S) ARE PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS, WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED. 

    2. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FTL DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, RELATING TO THE SERVICE(S) AND ALL FTL MATERIALS AND/OR OTHER FEATURES OR CONTENT AVAILABLE THROUGH THE SERVICE(S), INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. 

    3. FTL DOES NOT WARRANT THAT THE SERVICE(S) OR ANY PORTION OF THE SERVICE(S), OR ANY FTL MATERIALS AND/OR OTHER FEATURES OR CONTENT OFFERED THROUGH THE SERVICE(S), WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, AND DO NOT WARRANT THAT ANY OF THOSE ISSUES WILL BE CORRECTED. 

    4. FTL EXPRESSLY DISCLAIMS ANY WARRANTIES OF ANY KIND WITH RESPECT TO THE ACCURACY OR FUNCTIONALITY, VALIDITY, OR COMPLETENESS OF ANY INFORMATION OR FEATURES AVAILABLE THROUGH THE SERVICE(S), OR THE QUALITY OR CONSISTENCY OF THE SERVICE(S).

    5. FTL EXPRESSLY DISCLAIMS RESPONSIBILITY FOR ANY METAVERSE LOCATIONS, THIRD PARTY PLATFORMS, USER CONTENT, USER BEHAVIOUR OR OTHER CONTENT, ACTIONS, BEHAVOIURS OR FUNCTIONALITY OUTSIDE OF ITS CONTROL.

    6. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE SERVICE(S) OR ANY MATERIALS AND/OR OTHER FEATURES OR CONTENT AVAILABLE THROUGH THE SERVICE(S) WILL CREATE ANY WARRANTY REGARDING FTL OR THE SERVICE(S) THAT IS NOT EXPRESSLY STATED IN THESE TERMS. 

    7. YOU ASSUME ALL RISK FOR ANY DAMAGE THAT MAY RESULT FROM YOUR USE OF OR ACCESS TO THE SERVICE(S), YOUR DEALING WITH ANY OTHER PLATFORM, LOCATION, USER, AND ANY MATERIALS AND/OR OTHER FEATURES OR CONTENT AVAILABLE THROUGH THE SERVICE(S). YOU UNDERSTAND AND AGREE THAT YOU USE THE SERVICE(S), AND USE, ACCESS, DOWNLOAD, OR OTHERWISE OBTAIN MATERIALS AND/OR CONTENT THROUGH THE SERVICE(S) AND ANY ASSOCIATED LOCATIONS, ENVIRONMENTS, SITES OR SERVICE(S), AT YOUR OWN DISCRETION AND RISK.

17. Limitation of Liability

    1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FTL BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, NOR DAMAGES FOR LOSS OF REVENUE, PROFITS, BUSINESS, GOODWILL, REPUTATION OPPORTUNITY, SAVINGS, OR DATA ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE(S), FTL SOFTWARE OR ANY FTL MATERIALS AND/OR OTHER FEATURES OR CONTENT ON THE SERVICE(S), WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ANY FTL ENTITY HAS BEEN INFORMED OF THE POSSIBILITY OF DAMAGE.

    2. EXCEPT AS PROVIDED IN SECTION 15(c), THE AGGREGATE LIABILITY OF FTL TO YOU FOR ALL CLAIMS, LOSES AND/OR DAMAGES ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE THE SERVICE(S) ANY PORTION OF THE SERVICE(S) OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU MAY HAVE PAID TO FTL FOR ACCESS TO AND USE OF THE SERVICE(S) IN THE 3 MONTHS PRIOR TO THE EVENT(S) OR CIRCUMSTANCES GIVING RISE TO CLAIM; OR (B) £1.

    3. WE DO NOT EXCLUDE OR LIMIT OUR LIABILITY FOR DEATH OR PERSONAL INJURY ARISING FROM OUR NEGLIGENCE, FOR ANY FRAUDULENT MISREPRESENTATION MADE BY US OR FOR ANY OTHER STATUTORY RIGHTS WHICH ARE NOT CAPABLE OF BEING EXCLUDED. NOTHING IN THESE TERMS SHALL AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER. 

    4. EACH PROVISION OF THESE TERMS THAT PROVIDES FOR A LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS INTENDED TO AND DOES ALLOCATE THE RISKS BETWEEN THE PARTIES UNDER THESE TERMS. THIS ALLOCATION IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN THE PARTIES. EACH OF THESE PROVISIONS IS SEVERABLE AND INDEPENDENT OF ALL OTHER PROVISIONS OF THESE TERMS. THE LIMITATIONS IN THIS SECTION WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

18. Third Party Disputes

    1. FTL is not affiliated with any third party platform, service provider, third party destination or other third party, and any dispute you have with any third party platform, service provider, third party destination, or other third party, including without limitation any other user of any service, is directly between you and such third party.

    2. You irrevocably release FTL (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. 

19. Feedback

    1. If you provide FTL with any comments, bug reports, feedback, or modifications proposed or suggested by you for the Service(s), such feedback is provided on a non-confidential basis (notwithstanding any notice to the contrary you may include in any accompanying communication). 

    2. FTL will have the right to use such feedback at its discretion, including, but not limited to the incorporation of such suggested changes into the Service(s). You hereby grant FTL a perpetual, irrevocable, non-exclusive license under all rights necessary to so incorporate and use your feedback for any purpose.

20. Governing Law

    1. These Terms are governed by the laws of the England and Wales. 

    2. If a lawsuit or court proceeding arises under these Terms, then you and FTL agree to submit to the exclusive jurisdiction of the courts of England and Wales for the purpose of litigating any dispute. 

21. General

    1. We reserve the right to vary these Terms from time to time. By continuing to use and access the Service(s) you agree to be bound by any variation made by us. It is your responsibility to check these Terms of use from time to time to verify such variations.

    2. These Terms, and the documents, policies, codes, rules, guides linked to, are the entire and exclusive understanding and agreement between you and FTL regarding your use of the Service(s). 

    3. You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice or consent. 

    4. The failure to require performance of any provision will not affect our right to require performance at any other time after that, nor will a waiver by us of any breach or default of these Terms, or any provision of these Terms, be a waiver of any subsequent breach or default or a waiver of the provision itself. 

    5. If any part of these Terms is held to be invalid or unenforceable, the unenforceable part will be given effect to the greatest extent possible, and the remaining parts will remain in full force and effect. 

    6. Upon termination of these Terms, Sections 12, 13, 14, 15, 18 and 19 and any other accompanying agreements, will survive and continue to have effect and enforceability.

    7. Use of section headers in these Terms is for convenience only and will have no impact on the interpretation of any provision.
